What can you do to prove a driver who hit you was texting while driving?

Well, first, you're gonna have to get you a good lawyer because you're gonna need to subpoena those records, you're also going to... And we usually get this disinformation in the litigation process, you would... You got two ways, you can subpoena the records from the cell phone carrier directly, which is a heck of a process, I can't even begin to tell you. The other way is through the litigation discovery process whereby you request the information in the Interrogatories as well as the request for production of documents, you'll get the call log and you'll be able to see whether or not using those cool little towers they were on the phone at the time that the accident occurred.
