Tom Mustin:

What is the mediation process for personal injury claims in Alberta?

Steve Grover:

Mediation, it comes up all the time. You see that in the news or on the Internet. And essentially what that is, is a pre-trial settlement conference that we have with the other side, the other insurance company lawyer and their adjuster, where we sit down with them. We hire a mediator who's sort of like a facilitator, like a referee in a hockey game. He or she is not there to judge the case, they're just to be a facilitator to bring both parties together, myself and my client with the defense lawyer from the insurance company and the adjuster from the insurance company to come to some medium of where we could settle my client's case at. So we both, not only our office, but the defense lawyer and the insurance company can close their file too. It's sort of like... The good thing about mediation is we control the process. Like a trial, once we go to trial, the judge, he or she controls the process of how evidence is introduced but a mediation is a good way to try and settle their case.
