What is a Partition and Exchange Agreement in Texas Family Law?

Partition and Exchange Agreement refers to basically a contract that is between two parties that own property together, about how they're going to treat that property. And so that means that they have entered into a contract about, are they going to sell a home and how they're gonna divide those proceeds that they receive from the home, any other property that they own together. They don't necessarily have to be married, but typically we see that in a marriage situation that this is very similar to a post-nup of a partition and exchange. I've also seen it in some probate cases that they'll... The beneficiaries will agree to this partition and exchange.
