Nowadays, it's actually quite frequent that another driver may be using their cell phone, which can make it dangerous for all of us, besides actually having an eye witness or the other driver admitting to a police officer or someone else, that they were texting. Another option would be to send a preservation letter to make sure that they hang on to their cell phone and it isn't cleared, so that you can end up downloading that cell phone to compare and contrast any of the programs that they may have been using at the time that the crash happened, whether that be texting or an app or talking on their phone, you can actually gain that information from the download of their cell phone, so it's important that you get a lawyer involved as quick as possible.
