Dallas—Fort Worth Injury Lawyer Explains Statute of Limitations

Video Transcript:

Molly Hendrickson:

How long do I have to file an insurance claim after an accident in Texas?

David Shuster:

Well, you have two years from the date of the accident to pursue the claim, that's a statute of limitations, and really the important answer to that is, if you're going to get treated, you don't want a gap in treatment. So insurance claims have to do with medical injuries and so if you start to get treated and you have a gap in treatment, you want to get treated right away. And obviously, if you're getting treated and you're collecting all the records, it's always... The sooner the better is the answer to the question, but two years, you have to do something, you have to file a lawsuit within two years or you completely lose your right to collect.
