Do you need a police report to file an insurance claim in Texas?

David Shuster:

You do not need a police report to file an insurance claim in Texas. It can certainly be helpful when you have one, particularly if the officer draws a conclusion of who is liable and really particularly if the officer cites someone. In any serious accident, obviously you're going to have a police report, which is helpful for a variety of reasons, including accident reconstruction and stuff like that, but not necessary at all. And oftentimes people call the police and they say, "We're not going to come out, everyone's safe, the cars are off the road," so it's not necessary.
