Is it okay for a parent to move out of the marital home when filing for divorce in Texas? We asked Houston lawyer, Duana Boswell-Loechel for an Ask The Lawyers Quick Question.

Duana Boswell Loechel: 

It really doesn't matter in Texas whether they move out or not. It doesn't give up any of their rights to the home. Obviously, if they're going for primary custody, they may wanna stay in the home, just 'cause of that stability for the children.
