New York Lawyer Explains How to Tell if Malpractice Occurred

Video Transcript:

Judy Maggio:

Do parents always know right away if the birth defect their baby was born with was due to a medical mistake? Let's ask New York City lawyer Tom Markovits for an Ask The Lawyers Quick Question.

Tom Markovits:

Not necessarily no, some things you find out about later. Some things develop as the child develops, you may discover things which you didn't realize right at birth. The other issue is that in some situations, you do have a stronger suspicion that something went wrong, for example, a prolonged labor, an emergency C-section that's performed all of these things somewhat may give a hint, or at least the rise of suspicion that they may have been something more involved in the birth of the child that may have caused a problem or a developmental issue that's not clear right away.
