What is the difference between mediation and arbitration? We ask Texas attorney Jimmy Vaught in this AskTheLawyers™.

In mediation, the mediator can’t really do anything but instruct the settlement process. In arbitration, the parties agree to hire an arbitrator and there's kind of a trial basically with that private arbitrator, and that arbitrator makes a decision and it’s binding just like it would be by a judge.
