What are the benefits of arbitration? We ask Texas attorney Jimmy Vaught in this AskTheLawyers™ Quick Question.

Jimmy Vaught:

There are some benefits to arbitration, one of which is you choose your arbitrator. Usually the attorneys agree on an arbitrator, and so actually, instead of being in the court where you don't know who your judge is going to be all the time, the parties get to choose the arbitrator. The other benefit is they have the option to hire someone who has, let’s say, specialized knowledge in family. Another benefit is really flexibility; the parties and the lawyers can schedule hearings, reschedule hearings on their schedule and the arbitrator’s schedule, instead of relying on the court process. Also, it's somewhat cost-effective; you do have to hire the arbitrator and pay the arbitrator by the hour, but it's probably more cost-effective than actually preparing for trial and going into a full blown trial.
