Car Accident Lawyers Can Investigate Phone Records

Video Transcript:

Rob Rosenthal:

If you're in a crash and you think the other driver was on their phone, what can you do? We ask Kentucky attorney Tad Thomas in this AskTheLawyers™ Quick Question.

Tad Thomas:

I think it's important to call an attorney if you think someone who hit you has been on the phone. Call them as soon as possible, because an attorney can send out a letter and tell the defendant to maintain that phone and make sure that it's not deleted, it's not destroyed, or they don't get rid of it. Later on, the attorney can go and hire a forensic computer specialist to take a look at that phone and download the data on it. We can find out if they were on Facebook, if they were taking pictures, chatting, whatever the case may be, by doing a forensic review of that phone.
