Rob Rosenthal:

Is it possible to prove someone was texting and driving when they caused an accident? We ask California attorney Joel Siegal for this AskTheLawyers™ Quick Question.

Joel Siegal:

Well, they should tell us about it. We have the ability to subpoena records from people's cell phone carriers. We can learn that they were on the phone, and we'll take their deposition. We will also ask them point blank, “Were you on the phone?” If they say no, we'll compare that with the cell phone records, so it's easy to figure out these things.
