What should you do if you're injured in a car accident and you suspect texting and driving was the cause? We asked Utah lawyer Kevin Swenson for an Ask the Lawyers Quick Question.

If you think somebody has been texting or they were a distracted driver and they get in a crash with you, it's important that you do get to an attorney who is able to deal with that. And one of the things that we would always do in that type of a case is subpoena the cell phone records, so we actually see what's going on. If the case warrants, we'll download the phone so we can see, because sometimes people aren't just talking or texting, they're playing video games, they're chatting, they're doing all kinds of things in other apps, so distracted driving is a huge problem and needs to be dealt with.
