Like with any car accident, if your Uber driver is at fault, then you have the right to sue him or her, bring it to a court of law and recover. Since you are in an Uber, you will know exactly who your driver is, you should have it on your app and who the owner of the vehicle is, so it does make it a little easier to find out at least one of the parties at the beginning of the suit.
