Do you know if you should move out of your home when you file for divorce? We asked Austin attorney Jimmy Vaught in this AskTheLawyers™ Quick Question.

It kind of depends on the circumstances, but with so much going on in a divorce, it's kind of hard for both parties to live in the same household. It happens occasionally, but not very often. And there is sort of an urban myth that if someone moves out of the house, that they abandon the house. Whether someone moves out or not, if the house is community property it remains community property. It doesn't matter whose name the deed is in. If it was purchased during marriage it’s presumed to be community property.
