Tragedy can strike at any time.

Anytime you are walking within the vicinity of moving vehicles, there is the risk that if a driver is not paying attention, you could be injured. It’s important to know what you would do if that situation occurs, and how you can potentially protect yourself from a drawn-out legal battle.

If you are injured, seek medical care immediately, even if the pain is not severe or you think it will go away.

It’s a good idea to see a doctor whether your injury is major or minor after being involved in any kind of accident. This way, if your pain worsens later on, as it did for the woman in Maxwell’s story, you have a medical record to prove that the injury occurred when and how it did.

Be open with your attorney about what you hope to get out of the lawsuit, even if it’s just fair compensation and no complications.

In Maxwell’s story about a woman who was injured by a passing car on her way to yoga, the woman’s main concern upon realizing the pain from her injury was becoming significantly disruptive to her life was avoiding a lengthy lawsuit. This woman, like many others who sustain wrongful injuries but are hesitant to pursue legal action, did not want to go through the complicated inconveniences which are often involved in a legal battle. She did the right thing by contacting Maxwell and telling him exactly that. Maxwell was able to contact the at-fault party’s insurance company and request them to assign a defense lawyer, who he then invited to the law office to discuss a fair settlement, which the defense lawyer was more than open to after hearing the woman’s story.

Video Transcript:

She’s going to the yoga studio and she is walking with her little yoga mat and she is crossing the street. And as she’s crossing the street, there was a lawyer who was driving right through the intersection and he knocked her to the ground and her elbow shattered and she was laid up for weeks. She originally had no interest in getting a lawyer. But then this injury started wearing her down and she was in a lot of pain and she wasn’t sleeping. And so she contacted me and she said she wanted compensation. But she also said to me, “I don’t want to go through all this stuff involved in the lawsuit.” I contacted the insurance company and I said, what I would like you to do is assign a lawyer to this case to defend the case. I would like to give him the opportunity to interview my client and then have a pre-lawsuit mediation. So the defense attorney came to my office, my client, he asked her all the questions that he wanted and she told him the story of her life. And we got done. And he says, “Wow, I get it. And I’m going to report to the insurance company and I’m going to recommend that they pay a fair amount of money to compensate. And my client looked at me and she said, “This is what I wanted. I wanted to get compensation.” She says, “I’m feeling this is fair. And I really appreciate you doing this so that we can just get this case done.” And she went on with her life.
