Rob Rosenthal:

If you're in an accident while riding your motorcycle, how can an attorney help prove it's not your fault? We ask California attorney Joel Siegal for this AskTheLawyers™ Quick Question.

Joel Siegal:

Sadly, oftentimes after a biker is hit, the biker is down and not able to give statements to the police. So that comes down to our job of doing the investigation, of getting the police reports, of contacting witnesses, of doing forensic evaluations of the site of the accident, and learning where the other driver was. We’ll learn whether the other driver was drinking, we’ll learn whether or not he was on a cell phone. If the motorcycle driver isn't completely down and has observed things, he should mention it to the police, but we'll be interviewing our driver as well.
