Two prominent lawsuits filed against Monsanto were both filed in California. In these two separate cases, one person was initially awarded $289 million and the other was awarded $80 million. Both of these plaintiffs were diagnosed with non-Hodgkin’s lymphoma after continuous exposure to Roundup weed killer over the course of several years.
If a company is aware that the products it sells are dangerous, that company has an obligation to inform customers of the danger. Monsanto has issued a categorical denial that Roundup can lead to the development of non-Hodgkin’s lymphoma. Expert witnesses have been hired to provide testimony in support of the company’s defenses.
Monsanto has also spoken to the press about its plans to argue that all Roundup cases should be thrown out because the product was EPA-approved. This argument is called “preemption.” In May 2019, the Supreme Court decided a case favorably for plaintiffs involving preemption in prescription drug lawsuits. Cases like this provide precedent that should work in favor of the plaintiffs in cases such as the Roundup lawsuits.
