In May 2018, the Supreme Court declared the Professional and Amateur Sports Protection Act unconstitutional, opening the floodgates for legalization of sports betting at the state level. Several states are now pushing legislation to take advantage of the economic benefits of sports betting.
In Illinois, House Bill 3308 is making its way through the legislature, but the final form it will be in is uncertain. Five amendments to the bill have been proposed, including a so-called “bad actor” clause designed to bar certain gambling organizations from participating in the legalized sports betting market.
If the bill succeeds, Illinois will join six others that legalized sports betting in 2018 following the Supreme Court’s decision in Murphy v. NCAA.
Cory Aronovitz, Managing Member of Casino Law Group LLC, believes that we can expect a significant increase in sports wagering across the country. He says, “When an activity becomes socially acceptable, it then becomes politically palatable and thus regulated with a focus on maximizing revenues to the state while maintaining the integrity of the activity. That being said, each state's elected general legislative body is best to understand the specific concerns for their constituency. However, states that already have some form of regulated commercial gambling should seriously consider expanding to include sports wagering if for no other reason than competitive protection for its licensees that have made significant investment into that jurisdiction.”
