Defective household products can cause surprisingly catastrophic injuries. Various baby cribs, strollers, Roundup weed killer, and Johnson & Johnson baby powder are common topics of discussion in the field of product liability and are under ongoing litigation regarding injuries and illness caused by the use of these products.
Filing a product liability claim can be a good way to seek compensation for damages caused by a defective household product, as well as to hold the company accountable for producing the defective product in the first place. Injuries resulting from defective products can be costly and traumatic, and an injured party should not be left alone to cover these expenses. One of the most difficult things to ascertain in a defective product lawsuit is the identity of the liable party. Depending on the situation, the manufacturer, designer, or both could be considered liable and be subject to legal action.
Immediately after being injured by a household product, it is important to seek medical care. Some injuries may not be felt until days or weeks after the event, and others may not look as severe as they are. However, waiting to seek medical care could have a negative impact on any litigation down the road. It is also extremely important to maintain possession of the defective product, and if possible to take pictures of the product in the position it was in when the injury occurred.
If the product has already been turned into the Consumer Product Safety Commission (CPSC), the injured party can request to have it returned along with any of the original packaging or instructional material that accompanied the product. Without maintaining possession of the product that caused the injury, it can be difficult to prove that it was responsible.
Aside from the product itself, taking pictures of the product in the condition it was during the event, as well as all of the packaging and instructional material, can be imperative to the success of a case. Similarly, if the product caused additional damages such as fire, splatter, or other visible negative effects, it is important to take pictures of that as well.
Pictures of the injury should be taken initially and throughout the healing process to document its severity. Videos of the product in use and the contact information of anyone who might have witnessed it should also be collected and stored in a safe place where it cannot be lost or deleted.
In many cases, litigation over a defective product is already ongoing. It costs nothing to call around to different product liability law firms, asking if they are familiar with any ongoing lawsuits regarding that particular product. If so, you may be able to piggyback on that litigation. Find an experienced product liability attorney and let them know you want to be involved.
