New York City Work Accident Attorney Explains Options Beyond Workers’ Comp

Video Transcript:

Tom Mustin:

What is a third-party case when someone is injured on the job? We asked New York City Attorney Michelle Merman in this Ask The Lawyers Quick Question.

Michele Mirman:

In New York State, we have workers' compensation, that means that if you're hurt on the job, your medical benefits are paid and your time out of work is paid. However, the workers compensation does not pay for your pain and suffering, so New York says that if it's a third person, not your employer, responsible for the accident, you can bring that lawsuit, and that's called the third party lawsuit.
