Rob Rosenthal:

Do you need to hire a lawyer to make an insurance claim after a car accident? We're asking Calgary lawyer Steve Grover for this Ask The Lawyers Quick Question.

Steve Grover:

I recommend someone to hire a lawyer because obviously we do this day in, day out, every day. We've set up our office to litigate cases against insurance companies, we know what has to be proved in court to get your reasonable compensation. It takes time, it takes money, it takes patience, it takes resources to litigate a case. If you are a person injured in an accident, you're the plaintiff, you're making a claim against the other insurance company and their driver or owner who's the defendant, it's a burden of proof of the injured party to prove their damages to the court in Alberta. And obviously, our fee is based on a contingency fee where we work for free. At the end, we usually take a flat 30% of the settlement so I think there's a huge advantage of hiring someone who has the expertise, time, and resources to handle an injury case like our own firm.
