How much does a personal injury lawyer charge for a consultation and representation in New York? We ask lawyer Michele Mirman for this Ask The Lawyers Quick Question.

Michele Mirman:

So our fees are governed by New York State. For an accident our fee one-third of any recovery in addition to reimbursement for our costs and expenses. Costs and expenses change depending upon the type of case you have and how far long in the case you go. In a medical malpractice case, those fees also are governed by New York State, but they're very, very different. It's a sliding scale that starts at 30%, a little less than one-third of the amount recovered, and it goes down to... Recoveries over a million and a quarter, it goes down to 10% of the recovery, again, with expenses reimbursed. If there is no recovery, if there's no settlement, if there's no trial and verdict and recovery, then there's absolutely no attorney's fee or expenses to be returned to us.
