This video features Sarah E. Stottlemyer, an Employment and Labor Law attorney based in Georgia.
Tom Mustin:
How do you appeal a denial of a workers comp claim in Georgia? We ask attorney Sarah Stottlemyer in this Ask the Lawyers Quick Question.
Sarah Stottlemyer:
So if it's an actual denial that has been adjudicated by a state board worker's comp judge, you actually have to appeal that to the appellate division, and you have to file an enumeration of errors and then you have to go and do an oral argument in front of them, and then they determine whether or not your claim is compensable. If it's an actual just denial from your employer, you're gonna wanna reach out to the worker's comp carrier individually and get an attorney involved and as fast as possible.
