Juneau Attorney Explains Rights for Injured Crewmembers Under Jones Act

Video Transcript:

Rob Rosenthal:

What damages are available to an injured commercial fisherman in Alaska under the Jones Act? We ask Alaska attorney Mark Choate for this AskTheLawyers™ Quick Question.

Mark Choate:

The Jones Act gives you the ability to get your lost earnings. If you have permanent injuries, then you get your future lost earnings. You get your basic pain and suffering damages, you get your future medicals… One of the nice things about the Jones Act in Alaska is that the benefits are not restricted by the state statutes because it's a federal law. So in Alaska, someone could have similar injuries, let's say, while they're working driving a truck, but their recovery would be much more limited because Alaska has some caps on certain kinds of damages, but they don't apply in the Jones Act.
