Car Accident Attorney Explains Liability

Video Transcript:

Rob Rosenthal:

Do you know if Texas is a fault or no fault state when it comes to car insurance? What does that mean to you? We ask Texas attorney Alan Robertson for this AskTheLawyers™ quick question.

Alan Robertson:

When it comes to insurance, Texas is a fault state; meaning that for us to be able to prove your case, we have to prove that the person that hit you was in some regard negligent; meaning that they did something that a reasonable person would not do, or that they failed to do something that a reasonable person would do. Insurance companies are not just passing out money simply because you've been in a car wreck. It takes time and diligence to secure these means of proof to show that the other party made a mistake and that they need to be held accountable for that mistake.
