Jimmy Vaught:
Everything that the parties own at the time of divorce is presumed to be a community property, unless some could show the separate property. And separate property is generally things that you own before marriage. It could be real estate, financial accounts; however, take the financial accounts. To prove separate property you sort of have to connect the dots from before the marriage to the present. Occasionally we do have pretty big disagreements about what is separate property or not. It's not usual to have a forensic accountant or CPA to do a tracing.
