The criteria for filing for modification to a child custody issue in Texas is that there has to have been a substantial and material change in the parties’ or the children’s circumstances since the date of the last order. So, that can look like several different things. It could be that maybe the child has gotten older and is moving school districts; it could be the preference of the child, they want to live with one parent over the other now. There are just different things the court is going to look at to see if there's been a change in circumstances since the prior order.
