How do you know if you have a medical malpractice claim? We ask Kentucky attorney Tad Thomas in this AskTheLawyers™ Quick Question.

The way that we determine if someone has a medical malpractice case is to do an internal review of the medical chart first. We take a look; we have an in-house nurse who reviews the chart to see whether or not... If there’s smoke, there's fire. Then we take it and we turn it over to an expert witness depending on the specialty in the area that we're looking at. So sometimes it's emergency medicine, so we get an ER doctor to take a look at the chart. If it's an anesthesiology case, we hire an anesthesiologist who is an expert in the field to take a look at the chart and tell us whether there was medical malpractice.
