How do you find a good personal injury attorney to handle your case?

Aaron Allison is an attorney at The Law Offices of Aaron Allison in Austin, TX. In this Quick Question, he explains that you need to find an attorney who specializes in the area of law where you need help.

It’s important to hire a lawyer with specialization in injury law.

Law students decide on a particular type of law to study in school, and after graduation work on building that specialization through work experience with law firms that also house that specialization. For example, Allison is a two-part specialist in personal injury trial law and work injury trial law. If you have sustained any kind of injury in any kind of accident, it is important to contact an attorney who focuses on personal injury.

Just as a heart surgeon is technically licensed to examine a foot, any lawyer is licensed to practice injury law but might not have the necessary experience.

This is why it is important to look at what kind of cases a law firm handles before you consider one of their lawyers. Some law firms may claim to handle a wide variety of cases in different fields of law; this can be a red flag. In many cases, successful personal injury lawyers work for firms with other lawyers specializing in personal injury cases. This allows these attorneys to draw on each other’s experience and resources, as well as groom their experience to hone in on elements of the legal process that are specific solely to personal injury law.

It’s a good idea to ask questions about an attorney’s experience and track record before hiring them.

It’s important to ask questions before hiring an attorney. If you fell off a ladder and were injured at work, it’s a good idea to ask the attorney if they have handled any similar cases. If the answer is no, it might be wise to look elsewhere for legal counsel. The majority of reputable personal injury lawyers offer free consultations, which allows you to ask about their experience, track record for success, as well as their specific contingency fee.

Most personal injury lawyers work on contingency, which means they don’t get paid unless they recover money for you in a successful personal injury claim. Additionally, if it seems likely that your case will not settle fairly outside of court, ask if an attorney has trial experience to make sure they are prepared for and well-versed in the actual court proceedings should the situation come to it.

How do you choose a lawyer in a case where you've been injured? We ask attorney Aaron Allison in this AskTheLawyers.com Quick Question.

Aaron Allison:

You want to hire a lawyer who holds himself out to the public as a specialist in injury law.

Law is like medicine. We all go to law school, and we all come out of law school, and then we decide what kind of law we wanna practice and we specialize. We usually go to work for a firm that does one area of the law or we mentor underneath a very experienced and competent attorney who's an expert in a certain area of the law, and we specialize our practice to that area of the law.

I am a specialist in personal injury trial law and work injury trial law. I'm a two-part specialist. Any injury to a human being is my specialization in the law, no matter what it is. I don't do criminal law, I don't do probate law, I don't do contract law, don't do government law, I don't do environmental law.

I'm licensed to do that kind of law, just like a medical doctor who's a specialist in heart surgery, is licensed to examine your foot.

But he doesn't. He only focuses on hearts.

My specialization only focuses on injured human beings, the injured individual, and that's who I represent in any context.

I don't do the other areas of law.
