What benefits are available to a servicemember’s spouse after a divorce? We ask Texas attorney Jillian French in this AskTheLawyers™ quick question.

Jillian French:

After divorce, one of the obvious benefits is military retirement. The second one that goes along with military retirement is what’s called a Survivor Benefit Payment; what that does, is if a post-retirement servicemember predeceases the former spouse, the former spouse can still receive a portion of the military retirement benefit that they were receiving prior to the servicemember dying. Another benefit that they have is to look into whether or not they qualify for Tricare health insurance; that will depend on how long the marriage was going on during the active duty service period.
