Many of us live our lives on social media, but it’s not the place to discuss a car crash or subsequent injuries.

There are many benefits to social media, and it can be a great way to notify your social circle about fun updates in your life. However, it’s a bad idea to discuss elements pertaining to your case on social media. This includes posting pictures of your damaged vehicle or injury, and even any kind of post regarding the accident itself. Pretty much anything you post on social media can be twisted to use against you by the insurance companies.

Your post itself be used in court, and so can the comments about the post.

Even if the contents of your post are harmless, you can’t control what people comment, and those comments can be used against your case as well. Sometimes well-meaning friends can make comments in your defense that ultimately hurt your case in court. Sometimes a comment that may be harmless in reality can be written or perceived with an attitude that could cause its meaning to be misunderstood, which—again—could be potentially damaging to your case. These comments could even be used against the person making the comment, if not against you directly.

Posts and comments on social media are easy to misconstrue, and they could weaken your case.

Dominguez recommends avoiding discussing any aspect of your case on social media, even if you are merely expressing your feelings regarding your situation. While it is a good idea to take pictures or videos of the damage and/or injury you sustained, these should go straight to your attorney and nowhere else. Avoid discussing your case with anyone not directly involved, including your medical team, as whatever you say is subject to being written down in your medical record and could be used against you, just like whatever you post on social media or what your friends comment.

Ben Dominguez:

It’s a bad idea, and I’ll tell you why. Because when they do that, naturally people are going to comment, right? And then the person who posted the picture is going to say, okay, well, this happened or that happened, or that SOB, or whatever and any comments, you know, you never know how they can be misconstrued. They may be innocent. And typically, those comments in that situation depend on who’s saying what. They could go into evidence in court. Sometimes that is used against the person who makes the comment or the person who posts the pictures. So, I always tell my clients, please do not post anything about your injuries, about the accident, about what happened. It’s not necessary. And, you know, you expose yourself to potential harm as well.
