If you were involved in a tractor-trailer case, the advice that I would give my mother, a close friend, a close family member. A crash involving a large truck is not the same as a crash involving a small motor vehicle. If two cars collide, they’re vastly different than if a truck hit someone else.

Indiana is often referred to because of all the interstate highways that we have, as the “Crossroads of America.” As a result of that, we have a lot of heavy trucks on our roadways. We have a lot of semis. As many of you know who have traveled down I-65 or I-69 or I-70 or I-74, we’ve all had that image in our rear view mirror of that semi coming right up on our bumper. Semi drivers have very specific requirements. They have what’s called a commercial driver’s license. They have an obligation to inspect their truck. A driver who conducts a proper inspection before they take off in a semi, they’ll spend up to an hour checking all the brakes and all the linkage of the vehicle.
Many times, what we’ll find in semi/car collisions is that the semi driver never took the time to do that check. Many times, we’ll find the semi driver drove way too many hours. Many times, we’ll find the semi driver was driving way too fast for the conditions. If you’ve been seriously injured in a crash with a semi tractor trailer, you need to contact an attorney as soon as possible. First take care of your medical needs. Take care of the medical needs of your family member, but then contact an attorney because evidence will need to be obtained. Photographs will need to be taken. Measurements will need to be made at the scene of the collision. There, perhaps, will still be brake marks and marks on the road that could still be considered by an engineer to reconstruct what actually happened.
The records that a truck driver keeps, how long they’d been driving, is called a log. They’re only required to keep that for six months. Most trucking companies and most drivers know that and, after six months, they throw their logs out. Once the logs are gone, you no longer can prove they were over-driving. During your delivery you’re going through the labor process. You’re in a lot of pain and typically you want to get it over with. The nurses are watching the monitors. What they’re watching is to make sure your baby’s heart rate is what it should be, in other words that your baby is handling the contractions and the birthing process.
Many times what happens the nurses ignore warning signs on the monitors. Many times after the fact I can go and look at the strips on the monitors and find out that your baby had ten or 15 or 20 minutes of not receiving enough oxygen, where the heartbeat of your baby was down from the normal heart rate of a fetus of 120 to 140 beats a minute will be all the way down to 50 or 60 beats a minute and when that’s happening your baby is not getting enough oxygen to the brain. Now, when the baby is born the doctors will tell you, oh your child has hypoxic ischemic encephalopathy, HIE, and you’ll have no idea what that means. What that means is your baby had a lack of oxygen to their brain that caused the damage to their brain, and eventually your child will be diagnosed with cerebral palsy.
